Pending before the court are five motions for summary judgment, three filed by plaintiff, United States of America, and two filed by defendant, General Dynamics Corporation. The court, having considered the morass of pleadings in this action, makes the following determination:
Plaintiff filed its original complaint on May 7, 1987, under 42 U.S.C. § 7413 for permanent injunctive relief and civil penalties based on defendant’s alleged violations of the Texas State Implementation Plan (“SIP”) promulgated pursuant to the Clean Air Act, 42 U.S.C. §§ 7401-7642. After…
