This is an action at law to quiet the. title to certain land situate in Honolulu, Oahu. The defendant filed an answer of general denial and with it a plea in bar setting' up in substance the following: That in June, 1906, one Hikaalani Hobron Noholoa residing at Kalaupapa, Molokai, died testate seized in fee of the land in controversy; that the defendant was at that time her husband; that in the circuit court of the second circuit of this Territory, in probate, Tlikaalani’s will was upon the filing of a petition, the publication of…
