*212This is an appeal from an order and judgment dismissing the plaintiffs’ complaint in an action brought'in the district court, of Lewis and Clark County for the purpose of enjoining a special improvement district proposed by the City of Helena. The-appeal is on the judgment roll.

The complaint contained four separately stated causes of action. In the first cause of action the plaintiffs alleged in substance that the proposed district was void by reason of the inclusion of two streets.
