INTRODUCTION
Presently before this Court is a motion to dismiss filed by Defendants1 pursuant to Federal Rule of Civil Procedure 12(b)(1) and 12(b)(6), in which they seek dismissal of the single claim asserted against them by Plaintiff Joel Hendrick (“Plaintiff’), under the Fair and Accurate Credit Transactions Act.
