ORDER ON DEFENDANT’S MOTION TO DISMISS

SEITZ, District Judge.

THIS CAUSE is before the Court on Defendant’s Motion to Dismiss under Fed. R.Civ.P. 12(b)(1) and 12(b)(6) [D.E: No. 16]. Plaintiffs bring this class action lawsuit on behalf of Hungarian Jews, and their descendants, whose personal proper ty and valuables they believe were stolen and loaded onto the “Hungarian Gold Train” by the pro-Nazi Hungarian government during World War II, and later seized by the United States Army outside of Salzburg, Austria.
