This matter came before the Court on Defendants’ Motion for Summary Judgment and Memorandum in Support [Doc. No. 38], as well as Plaintiffs Motion to Strike Sham Defense Argument Or, Alternatively,' Request to Respond/Surreply [Doc. No. 51]. The motions present two issues.
