The petitioner appeals from an order of the Superior Court, Cumberland County, denying in part and dismissing in part his petition for post-conviction review. This Court has issued a certificate of probable cause, permitting the petitioner to proceed with his appeal on the single issue of whether an allegation of ineffective assistance of counsel consisting of the failure of counsel to file an appeal of sentence to the Appellate Division of the Supreme Judicial Court constitutes an attack upon the underlying criminal judgment that will support a petition for post-conviction…
