This is an appeal from an order denying the petition of Grattan D. Philips, Jr., for a partial distribution of the estate of Grattan D. Phillips, deceased. Grattan D. Phillips died intestate in the city and county of -San Francisco on the twenty-seventh day of November, 1925, leaving an estate consisting of real and personal property. He also left as his sole heirs at law Margaret A. Phillips, his surviving wife, and two children, Virginia Grattan Phillips and Grattan D. Phillips, Jr., the appellant.
