(After stating the foregoing facts.).

In the first special ground of the motion for new trial, the defendant alleges that the jurors trying his case and during its progress, read and discussed newspaper accounts of the trial published in the Atlanta Journal and the Macon Telegraph. This ground is supported by the affidavit of Harper, the bailiff who had charge of the jury during the progress of the trial. In his affidavit Harper deposes that the jurors read and discussed among themselves the account of the trial published in the Atlanta Journal of November 20, 1929, and that one of the jurors…
