Atkinson, Justice.

(After stating the foregoing facts.) The first ground of the motion is based on the refusal of the trial court to grant a continuance, the showing therefor being in the nature of a double-barreled motion, (a) for the reason that counsel and the accused had not had sufficient opportunity to prepare the case for trial, and (b) on account of the absence of certain witnesses. The manner of making the motion was by statements made to the court by counsel for the accused, and by questions propounded to the attorneys by the trial judge.(a) It was contended that counsel and the…
