THIS MATTER comes before the Court on the Defendant’s Motion to Exclude Supplemental Declaration of Jaime De La Ree and for Sanctions, filed April 2, 2007 (Doc. 312) (“Exclusion Motion”). The primary issue is whether the Court should consider the Supplemental Declaration of Jaime De La Ree, dated March 27, 2007, in making its determination on the Defendants’ Motion for Partial Summary Judgment of Non-Infringement of Claim 3 of U.S. Pat.
