HUNT, Circuit Judge.
Thomas Williams brought this action to recover damages for personal injuries which he alleged were suffered by him on account of the negligence of the Bunker Hill & Sullivan Mining & Concentrating Company. The mining company based its defense upon the ground of contributory negligence by Williams, and upon assumption of risk of the emplojunent in which he was engaged at the time he was hurt. Williams recovered a verdict. Thereafter the mining company moved the court to enter judgment notwithstanding the verdict, upon the ground that the evidence showed assumption of risk.…
