The following statement of the case was prepared by Mr. Justice Taylor as a part of the opinion: The respondent brought this action to recover damages for an injury which he received while working for the appellant in its saw-mill. The injury was received by having his leg caught in a cog-wheel gearing, which was in the vicinity of the place where the plaintiff was at work, and crushed so that it became necessary to amputate the leg above the knee. The learned counsel for the appellant claims that the .trial court erred in not nonsuiting the plaintiff upon its motion on the trial, upon two grounds: First.
