GOLDBERG, Circuit Judge:

Under the Age Discrimination in Employment Act of 1967 [ADEA], 29 U.S.C.A. §§ 621-34 (West 1975) (amended 1978), an aggrieved employee may commence suit against his employer for age discrimination only upon filing a notice of intent to sue with the Secretary of Labor within 180 days after the occurrence of the alleged unlawful act.1 This appeal presents two questions about the meaning and nature of this notice requirement.
