MEMORANDUM OPINION

DOHNAL, United States Magistrate Judge.

This matter is before the Court, by consent of the parties, on the Defendant Speed Channel, Inc.’s (“Speed Channel”) Motion for Summary Judgment (docket entry no. 7). 28 U.S.C. § 636(c)(1). This Court has jurisdiction pursuant to 28 U.S.C. § 1332. At the Plaintiff, Michael R. Webber’s (“Webber”) request, the Court took the motion under advisement pursuant to Fed.R.Civ.P. 56(f) and such case precedent as Harrods Ltd. v.
