PRICE, Chief Justice.

This is an appeal from the judgment of a District Court of El Paso County, 41st Judicial District. Proceeding was by quo warranto brought upon the relation of the town of Ascarate and Tracy, her Mayor, to determine the validity of the annexation of certain territory to the city of El Paso. The city of El Paso and her Mayor were respondents in the proceeding. The trial was before the court without a jury. Judgment upheld the validity of the incorporation of the town of Ascarate and enjoined the city of El Paso from in the future attempting to extend its limits so as to…
