■— In a proceeding pursuant to CPLR article 78 to review a determination dismissing petitioner from his position as Deputy Sheriff, he appeals from a judgment of the Supreme Court, Nassau County (Smith, J.), entered February 2, 1981, which dismissed the petition. Judgment reversed, on the law, with $50 costs and disbursements, and matter remitted to the respondents for a new hearing in accordance herewith.
