ORDER ADDRESSING MOTIONS AND GRANTING INTERVENOR-DEFEN-DANTS’ MOTION FOR SUMMARY JUDGMENT

I. INTRODUCTION
On May 28, 1991, this court entered an Order Granting Motion to Abstain and Denying Preliminary Injunction. In that order, although plaintiffs’ and intervenors’ motions for summary judgment had been fully briefed and argued, this court deferred ruling on such motions based on an appeal pending before the United States Supreme Court in the case of Lee v.
