delivered tbe opinion of tbe court.

Waddell Smith, sometimes referred to herein as tbe defendant, was convicted by a jury of second-degree murder and sentenced to serve twenty years in tbe penitentiary for tbe killing of John Bondes. On this writ of error tbe defendant’s main contention is that tbe verdict is not warranted by tbe evidence. .

At tbe time of tbe homicide tbe defendant was thirty years of age, a foreman of a group of orchard workers, and lived with bis wife and their foster child in tbe community known as Christians, in Augusta county. Tbe deceased, John Bondes, was…
