Upon a warrant issued on August 7, 1937, by the trial justice of Dickenson county, Morgan Sutherland was charged with having “in his possession about five pints of illegal whisky.” On appeal to the circuit court of that county from a conviction by the trial justice, he was found guilty and a fine assessed against him. The trial judge, in entering judgment on the verdict of the jury, added a further provision requiring the defendant to execute a bond with approved security in the penalty of $1,000, conditioned that the said defendant should not violate any of the provisions of the Alcoholic…
