This action was brought under the death-by-wrongful-act statute. It comes to the writer by reassignment.

On May 8, 1946, Eobert U. Gordon, 21 years of age, plaintiff’s decedent, accompanied the defendant Peter Pappas, Jr., another young man, from Shevlin to Bemidji, Minnesota, in the car of defendant Peter Pappas, Sr. They spent the late afternoon and evening in Bemidji and left for home around or after eleven o’clock.
