Plaintiff Gary Washburn appeals as of right from the trial court’s order denying plaintiffs’ motion for summary disposition pursuant to MCR 2.116(C)(10) and instead granting summary disposition for defendants under MCR 2.116(I)(2). We affirm. Defendants cross appeal as of right from the trial court’s denial of their request for attorney fees. We affirm in part, reverse in part, and remand.
