MEMORANDUM OPINION

DAVIDSON, District Judge.

Defendant, United States of America, has filed a motion for judgment on the pleadings pursuant to Rule 12(c) of the Federal Rules of Civil Procedure. Despite the fact that the government has moved for judgment on the pleadings, it has attached exhibits and affidavits which it advances in support of its motion.
