Preston, J. —

1. The large question in the case, as we view it, is whether the evidence was sufficient to take the case to the jury on the second count of the claim, though the errors assigned relate to the admission and exclusion of evidence, and other rulings as to both counts, and complaint is made of two or three instructions given by the court as to Count 1.
