In an action to recover damages for personal injuries, dant Town of North Hempstead appeals from so much of an order of the Supreme Court, Nassau County (Lockman, J.), dated August 2, 1996, as denied its motion to dismiss the complaint insofar as asserted against it.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, the motion is granted, the complaint is dismissed insofar as asserted against the defendant Town of North Hempstead, and the action against the remaining defendants is severed.
