Robinson v. Way

Appellate Division of the Supreme Court of the State of New York

Decided December 23, 2008PublishedCited by 3 opinions

1Opinion of the Court

The defendants Fred D. Way III and Law Offices of Fred D. *873Way (hereinafter together the defendants) contend that the Supreme Court erred in denying that branch of their motion which was to set aside so much of the jury verdict as was in favor of the plaintiffs and against them awarding compensatory damages in the principal sum of $29,100 and for judgment as a matter of law on the ground that the plaintiffs failed to establish a prima facie case of legal malpractice, or in the alternative, for a new trial on the ground that the verdict was against the weight of the evidence. We disagree.
