Bailey, Vanessa v. Potter, John E.
Court of Appeals for the D.C. Circuit
1Opinion of the Court
Opinion for the Court filed by Circuit Judge ROGERS.
ROGERS, Circuit Judge.
This is an appeal from the denial, for lack of subject matter jurisdiction, of motions to enforce a settlement agreement. We hold that because the district court did not dismiss the underlying complaint in accordance with Fed. R. Civ. P. 58(a), the district court retained jurisdiction over the motions to enforce the settlement agree ment. Accordingly, we reverse and remand the case to the district court.
