AKIN, Justice.

This is an appeal by Mrs. Robert 0. Wilson, defendant-landlady, from an adverse judgment rendered against her and in favor of her former tenant, William A. O’Connor, based on Tex.Rev.Civ.Stat.Ann. art. 5236e § 4 (Vernon Supp. 1976-77) after a trial before the court. Plaintiff O’Connor sued Mrs. Wilson for a “bad-faith” failure to return his security deposit. Although the trial court made no finding with respect to “bad faith” on the part of Mrs. Wilson, it nevertheless rendered a judgment against her for treble the amount of the deposit plus $100 and attorney’s fees, as…
