SUMMERS, Justice.
Plaintiffs, Roy Randolph and Jimmy Russell, are the owners and operators of a cafe and are engaged in selling beer containing less than three and two-tenths per cent alcohol by weight within the corporate *1002limits of the Village of Turkey Creek. The ■defendants are the Village of Turkey Creek, its Mayor, Aldermen, and Town Marshal.
