The issue presented is whether Irving Trust Company (“Irving”) acted properly in refusing to honor a letter of credit issued on behalf of plaintiff Dessaleng Beyene. Irving moves for summary judgment to dismiss the complaint against it on the grounds that it complied with the obligations which apply under the Uniform Cus toms and Practice for Documentary Credits (“UCP”) of the International Chamber of Commerce, 1 and that plaintiff Jean Hanson lacks standing to maintain this action.
