Appeal from District Court, Yellowstone County, Sydney Fox, Judge. Action by William D. Jenkins against C. H. Newman and others, as commissioners of Carbon and Yellowstone counties, to restrain said defendants from carrying out the terms of a certain contract. From a judgment for defendants, plaintiff appeals.

On the ninth day of November, 1908, the boards of county commissioners of Yellowstone and Carbon counties entered into a written contract with William S. Hewett and Arthur L. Hewett, copartners doing business as the Security Bridge Company, for the construction of a bridge across the Yellowstone river to connect the two counties.
