The defendant was convicted, September 25, 1928, upon the second trial, in the superior court of the county of Fresno, on both counts of an information which accused him in count one with making an attempt to commit murder, in that, on or about May 17, 1928, he did wilfully, unlawfully and with malice aforethought, attempt to kill and murder the Honorable C. E. Beaumont, who was then and there a judge of the superior court of the state of California, in and for the county of Fresno. The manner of the attempt to kill is alleged to have consisted in placing a certain explosive and inflammable…
