Today the Court rules on the Motion for Summary Judgment filed by Defendant James Miller on the Complaint for declaratory judgment filed by Plaintiff MAMA/TMU, L.L.C.’s (“MAMA”) as well as MAMA’s Motion for Summary Judgment on Miller’s Counterclaim. By agreement of the parties, the Court addresses summary judgment on Miller’s Counterclaim as though cross-motions for summary judgment were filed. (Tr. 65.)
