MEMORANDUM OF OPINION

MANOS, District Judge.

Respondent, E. P. Perini, Superintendent of Marion Correctional Institution, has custody of petitioner Willie Joe King. On March 22, 1976 petitioner was committed to the Ohio Department of Rehabilitation and Correction pursuant to an order of the Lo- rain County, Ohio, Court of Common Pleas. King is currently serving a sentence of eighteen months to five years for violation of Section 3719.09(A), Ohio Revised Code, illegal possession of narcotics, and he seeks federal habeas corpus relief pursuant to 28 U.S.C. § 2254.
