Appeal by defendant from a judgment of the Supreme Court, Queens County, rendered August 4, 1976, convicting him of burglary in the third degree, upon a jury verdict, and imposing sentence. Judgment affirmed. This case is remitted to the Supreme Court, Queens County, for further proceedings pursuant to CPL 460.50 (subd 5). Appellant argues on this appeal that, inasmuch as the only evidence connecting him to the burglary of a gas station was that his fingerprints were found on slivers of glass at the scene and since, conceivably, they could have been imprinted on the glass at a time other than…
