DECISION AND ORDER
MYRON L. GORDON, District Judge.
This action was commenced on August 19, 1994, with the filing of a complaint with the state of Wisconsin division of hearings and appeals. The defendant, Volkswagen of America, Inc., d/b/a/ Volkswagen United States, Inc. [“Volkswagen”], filed a notice of removal in the United States district court for the western district of Wisconsin on September 15, 1994. On October 3, 1994, the plaintiff, Doucas Volkswagen, Inc. [“Doueas”], made a timely demand for a trial by jury.
