LANDLORD-TENANT - LEASE VERSUS LICENSE - OCCUPANCY INCIDENTAL TO EMPLOYMENT Generally, a person who occupies premises belonging to an employer is not a tenant when the occupancy is incidental to, or necessary for, performance of the employment. The lack of rent payment required of an employee is a strong indication that no lease was intended.
