Blackmar, J.:
On January 30, 1915, officers of the law, armed with warrants to arrest the defendants McDonald and Lewis, but without a search warrant, forced an entrance into the dwelling house of defendant Lewis, where they found and arrested both of said defendants. At the same time they took from the person of defendant McDonald, and from tables and a drawer in a desk, certain papers which the People introduced in evidence upon the trial.
