Appellant as part of its business owns and operates in Collin county an oil pipe line for the purpose of distributing to its customers crude oil for various purposes. The pipes which carry and transport appellant’s oil are laid underground. Ap-pellee is a citizen of Collin county and the owner of a tract of farm land upon which there is and has been for many years a well of inexhaustible water, used for watering stock and other farm purposes.
