BRETT,-Judge'.

Plaintiff in error, Leo Gaines, defendant below, "was"charged by information in the District Court of Comanche County, Oklahoma,'"with the crime of'murder iri that" it was alleged that he ran down, on July 10;-1955, Daisey Johnson with his', automobile' and with felonious intent inflicted on her-body mortal wounds from which she did died He was tried by a jury, convicted of man-' slaughter- in the first degree, and his punishment fixed at twenty "'years in the state penitentiary. Judgment qnd sentence were entered accordingly from which this appeal has been perfected.
