I. INTRODUCTION

Before the court is a motion for summary judgment (Doc. No. 56), filed by Defendants the City of Montgomery, Chris Wingard and J.T. Conway. A brief and an evidentiary submission accompany the motion. (Doc. No. 57). Plaintiffs Urbanique Productions/Music Publishing, Cleveland Jointer and Xavier Jointer submitted a memorandum in response and an evidentiary submission (Doc.
