—Appeal by the defendant from a judgment of the County Court, Rockland County (Nelson, J.), rendered October 4, 1994, convicting him of murder in the second degree, upon a jury verdict, and imposing sentence.
Ordered that the judgment is reversed, on the law, and the indictment is dismissed with leave to the District Attorney to seek an order permitting resubmission of the charge to another Grand Jury.
