OPINION

KINKEADE, Justice.

Roger Reames, et al, appeal a summary judgment granted in this personal injury action in favor of Hawthorne-Seving, Inc. and Grubb Construction, Inc. based on a statute of repose requiring that certain suits against one who constructs an improvement to real property be brought within ten years after the construction of the improvement. See Tex. Civ. PRAC. & Rem.Code Ann. § 16.009 (Vernon 1986).
