This is an 'application for mandamus, and the case comes up on a state of facts found by the circuit court on the basis of the order to show cause against the application.

At the spring election of 1876 one George W. Few was elected highway commissioner of the township of Baraga and acted in the office until December 5th thereafter, at which time he was ousted by judgment in the nature of proceedings by quo warranto in consequence of having failed to give the required official bond.
