I. INTRODUCTION
Pro se petitioner Tracy Durden (“Dur-den”) seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Durden was convicted in New York State Supreme Court, New York County (the “trial court”), of one count of robbery in the second degree in violation of New York Penal Law § 160.10(1) and sentenced to imprisonment for a determinate term of 12 years.
