LUTTIG, Circuit Judge:

The plaintiffs, turned appellees, are several organizations that share the common goal of maintenance of water quality in North Carolina’s streams and rivers. These organizations brought suit against certain hog farms in North Carolina, alleging that these farms had violated the Clean Water Act (“CWA”), 33 U.S.C. § 1251, et seq., on several occasions by discharging swine waste into waters of the United States…
