Affirming.
Appellant was convicted of the murder of Tom McNary and sentenced to death. The homicide, which occurred on Sunday, February 5, 1939, in the city of Paducah, was wholly unprovoked, and the only excuse offered by appellant for his act is that he was so drunk at the time that he did not know what he was doing. Both the killer and his victim were negroes, the latter being about sixty-three years of age.
