FIRESTONE, Judge.

Pending before the court is the government’s February 23, 2004 Motion to Dismiss the plaintiffs complaint under Rules 12(b)(1) and 12(b)(6) of the Rules of the United States Court of Federal Claims. In his complaint, the plaintiff claims that the United States (“government”) breached a contract with him by extracting money from his prisoner’s account to pay for filing fees and associated costs for lawsuits initiated by him.
