*484In an action, inter alia, for a judgment declaring that the defendant is obligated to defend and indemnify the plaintiff in an action entitled Powell v Korson, pending in the Supreme Court, Orange County, under index No. 0785/05, the plaintiff appeals from an order of the Supreme Court, Orange County (McGuirk, J.), dated March 1, 2006, which denied his motion, inter alia, for summary judgment with leave to renew upon the completion of discovery.
Ordered that the order is affirmed, with costs.
