In an action, inter alia, to recover damages for emotional distress arising from the performance of an autopsy, the defendants third-party plaintiffs appeal from an order of the *637Supreme Court, Kings County (Martin, J.), dated October 27, 2005, which denied their motion for further discovery and granted the cross motion of the third-party defendants for summary judgment dismissing the third-party complaint.
Ordered that the order is reversed, on the law and as a matter of discretion, with costs, the motion is granted, and the cross motion is denied as premature.
